Terms and Conditions – Kawa Tours

Welcome to Kawa Tours. These Terms and Conditions outline the rules and regulations for booking and using our travel services. By booking a trip with us, you agree to be bound by the terms set out below.

1. Booking & Payments

  • All bookings must be confirmed in writing via email, WhatsApp, or our official booking platform.

  • A deposit of 30–50% is required to confirm your booking. The balance must be paid before the trip begins (unless otherwise agreed).

  • Payments can be made via bank transfer, mobile money (e.g., M-Pesa), or card.

  • Prices are quoted in Kenyan Shillings (KES) or US Dollars (USD) and may be subject to change due to currency fluctuations, park fee changes, or supplier price changes.

2. Cancellation & Refund Policy

  • Cancellations must be made in writing.

  • Cancellation fees apply as follows:

    • More than 30 days before travel – Full refund minus admin fee

    • 15–29 days before travel – 50% of total cost charged

    • 7–14 days before travel – 75% of total cost charged

    • Less than 7 days – No refund

  • No refunds are given for no-shows or unused services once the trip begins.

3. Amendments

  • Any request to amend a booking (e.g., change of dates or destinations) must be made in writing and is subject to availability and additional charges, if any.

  • Kawa Tours reserves the right to make necessary changes due to weather, road conditions, or safety concerns.

4. Travel Insurance

  • Travel insurance is highly recommended. It should cover medical expenses, cancellations, delays, personal liability, and lost baggage.

  • Kawa Tours is not responsible for any losses or costs incurred due to inadequate travel insurance.

5. Client Responsibilities

  • It is the client’s responsibility to ensure that passports, visas, vaccinations, and other travel documents are valid and up to date.

  • Clients must follow instructions from the tour guide/driver and respect local customs, laws, and wildlife safety rules.

  • Kawa Tours reserves the right to remove any client from a trip if their behavior causes danger, distress, or nuisance to others.

6. Liability Disclaimer

  • Kawa Tours acts as an agent for hotels, airlines, transport companies, and other service providers.

  • While we take all precautions to ensure a smooth trip, we are not liable for injury, loss, delays, or damages caused by third parties or circumstances beyond our control (e.g., strikes, natural disasters, road conditions).

  • In the event of illness or accident, we will offer reasonable assistance, but all medical costs remain the client’s responsibility.

7. Force Majeure

Kawa Tours is not responsible for non-performance due to acts of God, war, civil unrest, pandemics, government actions, or any other situation outside our control.

8. Use of Images & Testimonials

Unless stated otherwise, Kawa Tours may use photos or testimonials taken during the tour for promotional purposes. Please inform us in advance if you prefer not to be included.

9. Disputes & Governing Law

  • Any disputes arising from these terms or services provided by Kawa Tours shall be settled amicably.

  • If necessary, disputes will be handled under the laws of the Republic of Kenya.
